    Holmes v. City of New York

    Plaintiff verdict for $908,000 (Bronx Supreme) Plaintiff, a 48 year old school teacher was injured when he slipped and fell on a puddle of milk while teaching soccer in the school yard. Near where he was playing was dumpster into which the school janitor would throw garbage from the second floor window. Plaintiff contended that the milk containers which were in the garbage bags seeped out of the dumpster and into the playing area. The school custodian admitted that when he trew the bags he knew that they would break. The City of New York contended that the plaintiff should have seen the milk in the playground. The plaintiff suffered a right quadriceps tendon injury which required drilling four holes into the kneecap. Plaintiff walked with a slight limp for 2 years after the accident.

    Villegas v. Penske Truck

    The case settled before jury selection for $475,000.00. Plaintiff a 21 year female was injured as she was driving her car on a major thoroughfare. The defendant truck driver was merging into her lane and sideswiped her car. As a result she needed to be extracted from the car by the jaws of life. The defendant truck driver admitted that he never saw the plaintiffs car prior to the accident. As a result of the accident the plaintiff struck her head against the side window causing it to shatter. The resulted in the plaintiff sustaining TemporoMandibular joint Dysfunction (TMJ). She needed to undergo a bilateral surgery on her jaw to try to fix her TMJ. As a result of the accident she also needed to have arthroscopic surgery done to her knee. Had the case gone trial the plaintiff would have testified that she still experiences pain in her knee and pain the jaw.

    Fowler v. Green Bus Lines

    The case settled after jury selection for $242,500.00 Plaintiff, who was wheelchair bound was on a Green Lines Bus in the handicapped wheelchair area of the bus. As the bus was making a turn her wheelchair tipped over causing her to fall into the stairwell. Plaintiff successfully argued that the defendant driver had a duty to properly secure her into bus so that she would not tip over. Defendant further would have argued at trial that her back problems were due to a prior back condition as a result of her leg being amputated several years prior. Plaintiff sustained multiple injuries to her back resulting in two operations to her lower back. Plaintiff would have testified that she was not able to use her prosthetic device due to the accident.
